Privacy Policy

1. Scope of This Policy

This Privacy Policy applies solely to the LIOMNY brand website found at www.liomny.com (the "Site"), which is operated by Sigmapharm Laboratories, LLC. ("we," "us," or "our"), the manufacturer of LIOMNY. The Site provides information about LIOMNY, including how it works and its approved uses.

We do not sell, dispense, or ship LIOMNY through this Site, and we do not process orders, prescriptions, insurance, or payments. If you choose to order LIOMNY, the Site provides a link to an independent, third-party mail-order pharmacy, Marley Drug (the "Pharmacy") that is not owned by, affiliated with, or controlled by us. Any information you provide after leaving our Site - including your prescription, health, insurance, payment, and shipping information - is collected and handled by the Pharmacy under its own privacy policy and, where applicable, its HIPAA Notice of Privacy Practices. We do not receive, access, or store your order or prescription information. This Policy also does not apply to other websites operated by Sigmapharm Laboratories, LLC.

2. Information We Collect

Information you provide voluntarily:

Contact information and inquiries - if you email our inquiries address with questions about LIOMNY (for example, where to obtain it), we receive your name, email address, and the contents of your message. Your inquiry may reveal health-related information, and we treat inquiry contents with corresponding care. We retain inquiries in accordance with our internal record-keeping practices and applicable law; inquiries that contain an adverse event or product complaint information are subject to regulatory record-keeping requirements and may be retained for extended periods (see Section 10).

Adverse event and product complaint information - if you report a side effect, product quality issue, or complaint about LIOMNY, we collect the information you provide, which may include health-related information. Please note: as a pharmaceutical manufacturer, we are required by law to monitor communications we receive - including email inquiries - for reports of possible side effects. If your message describes a possible adverse event or product quality issue, relevant information from it will be processed for product safety and regulatory purposes, may be transferred to our pharmacovigilance service provider, and may be reported to the FDA as required by law, even if that was not the purpose of your message.

Information collected automatically: with your consent (see Section 9), we use Google Analytics to collect IP address, device and browser type, operating system, referring pages, pages viewed, links clicked (including whether you clicked the link to the Pharmacy), and usage data through cookies and similar technologies.

Please note: because this Site is about a specific medication, data about your visit to the Site may be considered "consumer health data" under certain state laws, since it could suggest an interest in, or use of, LIOMNY or the condition it treats. We treat such data with corresponding care, as described in this Policy.

3. How We Use Your Information

To respond to your questions and requests for information about LIOMNY;

To comply with FDA and other legal and regulatory obligations, including adverse event reporting and product safety monitoring;

To operate, secure, analyze, and improve the Site; and

To prevent fraud and enforce our terms of use.

We do not sell your personal information in exchange for money, and we do not use or disclose health-related information for third-party advertising. Analytics data is collected through Google Analytics only with your consent, as described in Section 9.

4. How We Share Your Information

Service providers. Vendors that host the Site, provide analytics (Google Analytics, configured as described in Section 9), and manage adverse events and complaint processing on our behalf (our pharmacovigilance service provider), under contracts or terms restricting their use of your information.

Regulators. The U.S. Food and Drug Administration and other authorities as required by law, including for adverse event and product safety reporting.

Legal purposes and business transfers. To comply with law or legal process, protect rights and safety, or in connection with a merger, acquisition, or sale of assets, subject to appropriate protections.

The link from our Site to the Pharmacy includes a referral identifier that allows us to measure, on an aggregate basis, how many visitors reach the Pharmacy's website through our Site. This measurement does not identify you personally, and we do not receive your identity, prescription, order, or health information from the Pharmacy, nor does the Pharmacy tell us which individuals ordered LIOMNY.  We do not share your personal information with data brokers or unrelated third parties for their own marketing purposes.

5. The Link to the Pharmacy

The Site contains a link to the Pharmacy's website for those who wish to order LIOMNY. The Pharmacy is an independent company licensed to ship to all 50 states. We do not control the Pharmacy's website or its privacy, security, or data practices, and this Policy does not apply once you leave our Site. The link includes a referral identifier used solely to count, in the aggregate, how many visitors reach the Pharmacy through our Site; it is not used to identify you or to track your activity on the Pharmacy's website. We encourage you to review the Pharmacy's privacy policy and HIPAA Notice of Privacy Practices before providing any information. The Site may also contain links to the corporate website of Sigmapharm Laboratories, LLC, the manufacturer of LIOMNY, which is governed by its own privacy policy, as well as other third-party websites, to which their own policies apply.

6. HIPAA Status

Sigmapharm Laboratories, LLC, is not a HIPAA covered entity, and information you submit through this Site is not protected health information ("PHI") under HIPAA; it is protected as described in this Policy and under applicable state privacy laws. Your prescription, dispensing, insurance, and payment records are held by the Pharmacy and are governed by the Pharmacy's own privacy practices and HIPAA.

7. Your Privacy Rights

Depending on your state of residence, you may have the right to: (a) know and access the personal information we hold about you; (b) obtain a copy of it in a portable format; (c) correct inaccurate information; (d) delete your personal information, subject to legal exceptions (such as FDA adverse event record-keeping requirements); (e) opt out of the sale of personal information, sharing for targeted advertising, and certain profiling; (f) limit the use of sensitive personal information; and (g) exercise these rights without discrimination. For consumer health data, residents of certain states (such as Washington and Nevada) additionally have the right to withdraw consent and to obtain a list of third parties with whom such data has been shared.

To exercise these rights, contact us using the information in Section 12. We will verify your identity and respond within the time required by law (generally 45 days). You may use an authorized agent. If we deny your request, residents of certain states may appeal by contacting us and referencing the original request; if the appeal is denied, you may contact your state Attorney General.

Requests concerning your prescription, order, or dispensing records must be directed to the Pharmacy - we do not hold those records.

8. California privacy Notice

This section supplements this Policy for California residents under the CCPA/CPRA. In the preceding 12 months we have collected: identifiers (name, email, phone, IP address); internet or other electronic network activity (Site usage data); and, where you voluntarily report an adverse event, sensitive personal information (health information). We collect these categories directly from you and from your device, use them for the purposes in Section 3, and disclose them to the recipients in Section 4. We do not sell personal information for money and do not knowingly sell or share the personal information of consumers under 16 years of age. We use and disclose sensitive personal information only for purposes permitted by the CCPA. Where required, we honor Global Privacy Control (GPC) browser signals as a valid opt-out for the browser or device transmitting the signal.

9. Cookies and Analytics

The Site uses cookies and similar technologies for essential functions and analytics. Specifically, we use Google Analytics to understand how visitors use the Site (such as pages viewed, time on Site, and whether visitors click the link to the Pharmacy). We have configured Google Analytics for basic measurement purposes: advertising features, demographics, and Google Signals are disabled, and we do not permit Google or any other third party to use data collected from the Site for advertising or to build profiles about you.

When you first visit the Site, a cookie banner allows you to accept or reject non-essential cookies. Analytics cookies are not set unless you accept them, and you may change your choice at any time through our cookie preferences tool at [link]. Where required by law, we also honor Global Privacy Control (GPC) browser signals as an opt-out for the browser or device transmitting the signal. Essential cookies necessary for the Site to function are used regardless of your choice.

10. Data Retention and Security

We retain personal information for as long as reasonably necessary for the purposes described in this Policy, taking into account our business needs, record-keeping practices, and legal and regulatory obligations. Adverse event and product complaint records - including email inquiries containing such information and copies transferred to our pharmacovigilance service provider - are retained as required by FDA regulations and are exempt from deletion requests to the extent required by law. Other inquiries and correspondence may be retained for our records consistent with applicable law. We maintain reasonable administrative, technical, and physical safeguards appropriate to the sensitivity of the information. No system is completely secure, and we cannot guarantee absolute security.

11. Children's privacy; U.S. Users; Changes

The Site is intended for U.S. residents 18 and older. We do not knowingly collect personal information from anyone under 18, and we do not knowingly sell or share the personal information of consumers under 16. Information you provide will be processed and stored in the United States. We may update this Policy from time to time; material changes will be posted on this page with a new effective date.

By continuing to use our website, you acknowledge and accept the revised Privacy Policy. If we make material changes to how we handle previously collected personal information, we will provide notice as required by applicable law.
